These Terms of Service (“Terms”) apply when you create an account or workspace on, or otherwise use, WhizzSocial (the “Service”), a product of WhizzAct Private Limited (“we”, “us”). By using the Service you agree to these Terms. If you accept them for an agency or company, you confirm you may bind it, and “you” means that organisation.
1. Your account and workspace
- You must give accurate details and keep your sign-in secure. Owners and admins must use two-step sign-in.
- A workspace belongs to the agency or business that created it. Its owner decides who has access and with which role, and is responsible for what members do in it.
- Tell us straight away if you think someone has used your account without permission.
2. Social networks
- The Service connects to social networks (such as Facebook, Instagram, LinkedIn, YouTube and X) through their official interfaces. You connect accounts with each network’s own sign-in, and you may disconnect them at any time.
- You must have the right to manage every account you connect, including your clients’ accounts.
- Each network’s own terms and policies also apply. Networks may change or limit what other apps can do; when that happens some features may change or stop working, and we are not responsible for a network’s decisions or outages.
3. Your content and your clients’ data
- You keep all rights in the content you upload, create or publish. You give us permission to store, process and send it only to provide the Service to you.
- For personal data about your clients, their customers or anyone else that you put into the Service, you decide why and how it is used, and we process it on your instructions. You are responsible for having the consents or other legal basis needed.
- You are responsible for what you publish. Don’t use the Service for unlawful, misleading, hateful or infringing content, spam, or anything that breaks a network’s rules.
4. Acceptable use
Don’t try to access other workspaces or our systems without permission, disrupt the Service, get around its limits or security, resell it without our agreement, or use it to send unsolicited messages. We may suspend access to protect the Service, other customers or the law.
5. Plans, payment and GST
- New workspaces start with a free trial for the period shown on our pricing page. No payment details are needed for the trial.
- Paid plans are billed in advance, monthly or yearly, in Indian rupees through our payment partner Cashfree, using UPI Autopay or a card. The plan renews automatically at the end of each period until you cancel.
- Prices are shown without GST. GST at the applicable rate is added, and we issue a GST tax invoice for every payment. Add your GSTIN in your billing details to have it on your invoices.
- If a payment fails, we may retry it. If it remains unpaid, your workspace gets a short grace period and is then paused: you can still sign in, see billing and export your data, but publishing is held until payment is made.
- We may change prices for future periods. A change does not affect the period you have already paid for, and we will tell you before it applies to you.
- Cancellations and refunds are covered by our Refund & Cancellation Policy. For invoice and billing questions, write to account@whizzact.com.
6. Plan limits
Each plan includes limits (such as clients, connected accounts, team members, scheduled posts and storage). When you reach a limit, you can upgrade or remove something to continue.
7. Ending the service
- You can cancel your plan at any time from the Billing page. You keep access until the end of the paid period.
- A workspace owner can ask to delete the workspace. It is deleted after a 30-day grace period, during which the request can be cancelled. See Data deletion.
- We may suspend or end your access if you seriously or repeatedly break these Terms, or if required by law. Where reasonable, we will tell you first and give you the chance to export your data.
8. Availability and changes
We work to keep the Service available and secure, but we can’t promise it will be uninterrupted or error-free. We may improve, change or remove features; if a change takes away a major feature you pay for, we will tell you in advance.
9. Liability
- The Service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, loss of profits, revenue, data or goodwill, or for the acts, rules or outages of social networks and other third parties.
- Our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the 12 months before the event that gave rise to the claim.
- Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnity
You will compensate us for claims by third parties arising from content you publish or upload through the Service, or from your breach of these Terms or the law.
11. Privacy
How we handle personal data is explained in our Privacy Policy.
12. Changes to these Terms
We may update these Terms. We will post the new version here with a new date and, for important changes, tell workspace owners by e-mail or in the app before they take effect. Continuing to use the Service after that means you accept the new Terms.
13. Law and disputes
These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising from them, subject to any rights you have under consumer protection law.
